Bankruptcy Process

  • IN-PERSON/TELEPHONE/VIDEO INITIAL MEETING –

    All cases begin with a free 30 – 60 minute meeting with attorney David Hilbern. In today’s age, business is routinely conducted by telephone/video and internet. No longer do you have to drive for hours to meet with your attorney. While it is an honor to meet, personally, each and every one of our clients, we understand that for health reasons, time off work, and the high price of gas, in-person meetings can be inconvenient or impossible. Don’t worry, we’ve been doing this a long time, and you will receive the same level of service no matter how you choose to proceed.

  • DOCUMENT GATHERING –

    Documents are very important in preparing a bankruptcy case. Many of the required documents must be filed with your bankruptcy case or turned over to the bankruptcy trustee. While we make every effort to take the workload off of our clients, there are just some things we cannot get ourselves. Once we receive all the necessary documents and interviewed you, we will start to prepare the bankruptcy petition, schedules, statement of financial affairs, and other necessary documents. Once we have everything prepared, we will go over everything prior to filing your case with the court.

  • MEETING OF CREDITORS –

    Once all the necessary documents have been filed and/or turned over to the bankruptcy trustee, you will be required to testify under oath at what is called, a meeting of creditors or 341 meeting. Don’t worry, we will prepare you and we will be there with you when you testify.

  • DISCHARGE –

    After you testify at the meeting of creditors, you will have to wait, in a Chapter 7 case,  approximately 60 days. After that time, the bankruptcy judge will issue a discharge order, discharging all or most of your debts. At that time, your case is essentially over and you are free to start rebuilding your financial life with a clean slate.

    In a Chapter 13 case, you will have to continue to make payments to the bankruptcy trustee for approximately 3 to 5 years, until the bankruptcy plan is paid. At that time you will receive a discharge of any unsecured debts that were not paid during the bankruptcy.
